The following terms and conditions lay out the nature of the relationship between Content Vista and its clients. Kindly go through these terms and conditions carefully. By using this website and availing our services, you are acknowledging, agreeing and accepting all of these terms and conditions.
These terms and conditions are effective from 22nd October, 2017 and are applicable to all orders / projects taken up by Content Vista Services.
The website http://contentvista.com (this website) is owned and operated by Content Vista Services (“Content Vista”, “Content Vista Services”, “we” or “us”) and we reserve the right to make revisions, add and remove information to these terms and conditions as per our discretion.
If you do not agree with any of the following terms and conditions, we advise you to stop using our website and services.
We may update these terms and conditions without any prior notice to visitors of this website. By using this website, you agree that it is your responsibility to go through these terms and conditions to keep yourself updated of any change. Accordingly, we advise you to visit this page regularly to check for revisions and updates. In case you keep using our website after a revision, update or change to these terms and conditions, it is implied and assumed that you agree with the revision, update or change.
It is expressly stated that the user / visitor shall assume all risk and responsibility for using the website http://contentvista.com. Content Vista Services shall not be responsible or held liable for any damage, penalty, loss, injury or claim (direct or indirect) arising out of the use of this website. Even if Content Vista Services may have been advised or had knowledge of the possibility of any damage, penalty, loss, injury or claim (direct or indirect) could arise from the use of this website, we will not be held liable.
Content Vista creates content for clients in the form of website content, articles, blogs, profiles, social media content (Facebook, Twitter, LinkedIn), content for advertising, brochures, product descriptions, product reviews, press releases, email content, newsletters, direct marketing materials and any other form (not expressly mentioned before) as directed by our clients.
We assure that the content we provide to clients is 100% original and checked for plagiarism. However, exceptions to this may include certain content written for legal and technical purposes that require the exact usage of certain words or phrases to be considered accurate. In such a case, Content Vista shall inform the client of this fact before final submission.
While taking up an order from a client, Content Vista asks for complete information about the service(s) the client requires or special requirements (if any). Before start of an order / project, our executive shall contact the client and go through a detailed service brief. We assure that we will try our best to match up to client instructions and requirements.
In case a client feels that his/her instructions have not been complied with or the content submitted is not as per requirements, we will rework and revise the content but within reason.
However, if we believe that any client is being unreasonable with his/her requirements or changing his/her stance repeatedly or misusing, exploiting or taking advantage of our revision policy, we reserve the right to refuse the revision(s) asked for by the client and discontinue the business relationship without notice. No refund in this case shall be made for any amount that has already been paid by the client.
Any disputes will be taken up based on the pre-decided requirements and terms at the start of the order / project, reasonable business practices and these terms and conditions.
ENGLISH LANGUAGE FORMAT
It is the responsibility of the client to inform us about the preferred format of English language. For instance, spellings of words in British English or American English may vary. If the client does not inform us of the desired English language format, the content will be delivered in the British English format.
ORDER / PROJECT CANCELLATIONS
An order once placed can only be canceled if no work has been started on the order / project. No order that has been fully completed can be cancelled and the client will have to pay the full amount agreed upon beforehand. If a client wishes to cancel an order / project on which any work / part has been completed, the client will be responsible for the payment of expenses incurred on the work / part that has been completed based on the percentage of the order / project completed.
Content Vista will hold copyright over the content produced by any of our writers till full payment for the work is received from the client. After receipt of full payment, we will no longer hold copyright on the content and the copyright for the content will be legally transferred to the client. Thereafter, the client is free to use the content as per his/her wishes. The transfer of copyright to the client upon receipt of full payment is an implied transfer of copyright and no separate contract is required to make this agreement legally binding.
In case a client does not make full payment for an order / project, the copyright for the delivered content shall lie with Content Vista Services and the content shall not legally belong to the client. If the client uses the said content in any manner (online or offline) without making payment for the same or without the express permission of Content Vista Services, this shall be treated as a breach of copyright and we reserve the right to take appropriate legal action against the breach.
SUBMISSION AND REVIEW OF CONTENT
Content ordered by a client will be, upon completion submitted to the client for review. The client can inform us of any revision, update or change required in the content submitted within four (4) days (excluding the day on which content is submitted). If the client does not revert back within four (4) days, it will be assumed that the client is satisfied with the content. In case the client wants any revision, update or change to the content after the expiry of the four (4) days review period, the client will have to bear additional charges.
A revision is defined as minor adjustments to content in terms of correcting grammatical errors, changing the structure of content etc.
Please note that we are not obligated in any way to rewrite the content unless there has been a major error on our part while creating content for a client. Only in case such a major error has been made on our part will we rework and rewrite the content which will be submitted within a timeframe that is deemed reasonable by Content Vista.
Content Vista allows clients to ask for unlimited revisions but within reason. If we believe that any client is misusing, exploiting or taking advantage of our revision policy, we reserve the right to refuse the revision(s) asked for by the client and discontinue the business relationship without notice.
PAYMENT AND REFUND TERMS
We work with 100% advance payment for all orders / projects. Any other charges (as applicable) shall be borne by the client. We may, however, allow for exceptions to the 100% advance payment policy on a case to case basis.
As a policy, Content Vista shall not provide any refunds due to the time invested by us in completing a client’s order / project. Any request for refund must be made within four (4) days from the day the content is submitted (excluding the day on which content is submitted). If the client does not revert back within four (4) days, it will be assumed that the client is satisfied with the content.
In case a client is not satisfied with the content delivered, we will try to rework and revise the content to his/her satisfaction.
However, if we believe that a client is misusing, exploiting or taking advantage of our revision policy, we reserve the right to refuse the revision(s) asked for by the client and discontinue the business relationship without notice. No refund in this case shall be made for any amount that has already been paid by the client.
Any request for refund shall be reviewed on a case to case basis and the final decision shall be the discretion of Content Vista Services.
As already stated above, if a client does not make full payment for an order / project, the content shall not legally belong to the client and it will be treated as a breach of copyright. If the client uses the said content in any manner (online or offline) without making payment for the same or without the express permission of Content Vista Services, we reserve the right to take appropriate legal action against the breach.
PROTECTION OF CONFIDENTIAL INFORMATION
We understand that you may at times provide us confidential information (personal or business information) to help us complete your order. We assure that we will protect the said confidential information to the best of our ability.
To prevent unauthorized access or disclosure of information, we have in place appropriate physical and electronic procedures to safeguard and secure it. We will never disclose your confidential information intentionally but Content Vista will not be responsible for any breach or malfeasance by any of its employees (present or former) acting independently, or by any other person outside the control of Content Vista.
